One for the Little Guy

Air passengers have been entitled to claim compensation for delays of more than three hours, where no “extraordinary circumstances” exist, following the European Court of Justice’s (ECJ) Sturgeon ruling in November 2009.

However, since August 2010, all such claims have been put on hold by British airlines, after several carriers, including BA, easyJet and Thomson, referred the issue back to the ECJ.   This week, a judge at Middlesborough County Court ruled that airlines must continue to answer individual claims, and need not wait for the ECJ’s response.

Good, let's hope they are able to back date any claims.



Every day an estimated 6,000 British air passengers are entitled to claim up to £476 as compensation for flight delays, meaning that up to £130 million has gone unclaimed since August.
